\nThank you for visiting the PostOddz Mobile Application (the “App”), which is owned and operated by FABOPS, Inc. (“PostOddz”). PostOddz recognizes and respects the importance of maintaining your privacy, and as a result, we have established this privacy policy (“Privacy Policy”). Throughout the Privacy Policy, the terms “we,” “us,” and “our” refer to PostOddz and the terms “you” and “your” refer to any visitor to or user of the App. This Privacy Policy is intended to help you understand the types of information we may collect from you or that you may provide when you download, install, register with, access, or use the App, and describes our practices for collecting, using, maintaining, protecting and disclosing such information. This Privacy Policy only applies to information that we collect, or store or that you provide to us through the App or when you communicate with PostOddz via email, and does not govern information collected from you in any other manner. We make no representations or warranties regarding: (i) the websites, apps, or policies of any third-party (including any third-party website or app that the App may link to or the policies of such third-party websites or apps) or (ii) how any third-party will handle your Personally Identifiable Information. We encourage you to review the privacy policy of any third-party website or app before accessing such website or app. In viewing and using the App, you understand that PostOddz may use certain information, including your Personally Identifiable Information (as defined below) subject to the terms of this Privacy Policy, and you consent to (i) the terms of this Privacy Policy; (ii) to the collection, use, and sharing of your Personally Identifiable Information and other information by PostOddz pursuant to the terms of this Privacy Policy; and (iii) to the terms and conditions of the Terms of Use located in the homescreen of the App (the “Terms of Use”). You may only access and use the App if you are located within the United States, so only those laws applicable throughout the United States are implicated herein. The App is only intended for use by persons in the United States. If you do not agree to the terms of this Privacy Policy, please exit our App and do not provide Personal Information to us.

\nWhen you download, register with or use the App, we may collect information from you subject to the terms of this Privacy Policy, including information by which you may be personally identified (“Personally Identifiable Information”) as well as information that is about you, but that does not identify you individually. The information we may collect and maintain about you includes but is not limited to your:
\n* Contact information, such as name, email address, zip code, and telephone numbers, including mobile telephone numbers;

\n* Gender;

\n* Provide you with access to specialized portions of the App (your “PostOddz Account”);
\n* Verify your identity and age;
\n* Suggest “friends” for you to connect with on the App;
\n* Allow you to invite your mobile phone contacts to participate in the App;
\n* Store information about your preferences, allowing us to customize your PostOddz Account according to your individual interests;
\n* Contact you to respond to inquiries related to the App;
\n* Notify you when App updates are available;
\n* Send you any prizes that you have won;
\n* Communicate with you to provide you with relevant information about PostOddz, including special promotions, discounts and newsletters;
\n* Process orders and collect payments;
\n* Enforce or apply our Terms of Use and other agreements;
\n* Comply with licensing and regulatory requirements;
\n* Combat against security risks and fraudulent activity;
\n* Perform research and development, market research, customer surveys and customer profiling; and
\n* Confirm your geographic location.
\n\nWe collect Personally Identifiable Information for the purposes of providing these services, but may collect non-personal information in order to operate, maintain, and improve the App and our services. We will collect Personally Identifiable Information from you if you voluntarily submit such information to us through the App or if such information is transmitted to us when you access the App, when you contact us or during our communication with you based on the information you’ve submitted to us. PostOddz allows users to send messages to individuals stored in their mobile phone contacts in order to invite such individuals to participate in social gaming via the App. To invite your contacts to participate in the App, you must opt-in to allow PostOddz to access your mobile phone contacts. By opting-in you authorize PostOddz to access and use the names and phone numbers of the individuals stored in your mobile phone contacts so that you may use this feature. In the course of a free-to-play game, we may award a prize or prizes, such as a cash prize. We will collect your mailing address from you to send the winner or winners such prizes. In certain cases of prizes worth $600.00 or more, we may collect your social security or taxpayer identification number and address so that we can provide you with relevant tax forms. Any taxes due are your responsibility. You have a choice as to whether to provide us with Personally Identifiable Information. By submitting Personally Identifiable Information through the App, you agree to the terms of this Privacy Policy, you expressly consent to the use, processing, and sharing of your Personally Identifiable Information according to this Privacy Policy and you agree to the Terms of Use located in the homescreen of the App. You may choose not to provide certain information to us, but if so, you may not be able to participate in certain activities and transactions available at or through the App.
\n \nWhen you download, access, and use the App, it may use technology to automatically collect:
\n* Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App.
\n* Device Information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.
\n* Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
\n* Location Information. This App may collect real-time information about the location of your device in order to confirm your location and for statistical and operational purposes. You can choose whether or not to allow the App to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some parts of the App may then be inaccessible or not function properly. If you do not want us to collect Usage Details, Device Information, or Stored Information and Files, do not download the App or delete it from your device.
\n\n3. Information Use and Sharing
\nWe may employ other companies and individuals to perform functions on our behalf. Examples include postal mail and email communications, payment processing, customer lists management, data analysis, marketing services and assistance (including providing marketing services presented on other websites or mobile applications), credit card processing, and customer relationship management. These companies and individuals have access to Personally Identifiable Information and other information needed to perform their functions, but they are not permitted to use such information for other purposes without our permission. We also reserve the right to use your personal information for any other purposes that are reasonably ancillary to the business of providing you with services related to the App. Except as provided in this Privacy Policy, or as otherwise permitted or required under law, we reasonably attempt to ensure that we do not intentionally disclose any Personally Identifiable Information about you as an individual user to any third party without having first received your permission (through your opting in or otherwise agreeing to the disclosure of such information). We will release information, which may include Personally Identifiable Information, as required by law to comply with any valid legal inquiry or process such as a search warrant, subpoena, statute or court order. We will also release specific information, which may include Personally Identifiable Information, in special cases, such as if there is an attempted breach of the security of the App or if there is a physical or property threat to you or others. We may also transfer user information, including Personally Identifiable Information, in connection with a corporate merger, consolidation, the sale of related assets or corporate division or other fundamental corporate change, or a financing or similar transaction, including as part of the diligence process for these transactions. We may provide access to your Personally Identifiable Information and other information to our contractors who are performing services for us in connection with our App. Additionally, we may share your Personally Identifiable Information in connection with enforcing or applying our Terms of Use and other agreements or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of PostOddz, our customers or others.
\nWe may allow you to refer friends to the App via email, text message, and social networking platforms. If you refer a friend by email or text, we will collect the name and email addresses of proposed recipients or, if applicable, the name and mobile number of your friends to send the email or text on your behalf. We may also use your name and email address in order to identify you as the initiator of the email. Please inform your friends that we may send them emails or texts on your behalf. If you refer a friend via any social networking platform, you will be subject to the privacy policy and the terms and conditions of the specific social networking platform. Some social networking platforms enable functionality that allows a user to receive and transmit data to the social networking platform through use of overlays or other technology. Although it appears the data is collected by us, the data is in fact collected directly by the social networking platform. If you decide to use this functionality, the data to be transmitted will be collected directly by the social networking platform, and we do not receive, collect or use the information. Please note your social networking account settings, as those settings will affect how and with whom your posts, information and other content are shared.
\nWhen you use the App, we collect your Personally Identifiable Information (such as your name) and your mobile phone number to allow PostOddz or a third party acting on PostOddz’s behalf to contact you for customer service purposes and also to inform you of or follow-up with you about special promotions, optional contests, and special offers. We will share such information with necessary third parties for the purpose of carrying out the customer service, contest, special offer or promotion. You hereby expressly agree that PostOddz or a third party acting on behalf of PostOddz may contact you using the contact information you have provided to us or that have collected (including any phone numbers) concerning your PostOddz Account or in connection with carrying out customer service, promotional offers and contests. You can always opt-out of receiving marketing communications from us by clicking “unsubscribe” link in our promotional materials, or by emailing us at info@postoddz.app. We also reserve the right to use your Personally Identifiable Information to send you communications regarding changes to this Privacy Policy or the Terms of Use.
\nIf you provide information to be published or displayed (“Posted”) on public areas that may be available on the App, such as Personally Identifiable Information or other information (collectively, “User Contributions”) that information is transferred to others at your own risk, and can be collected and used by third-parties and by us, without limitation. Although you may set certain privacy settings for such information, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may chose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. We recognize that you do not submit Personally Identifiable Information in any public or semi-public forums, such as message boards or chat rooms.
\nTo the extent permitted by applicable law and subject to this Privacy Policy, we retain personal information we obtain about you as long as (i) it is needed for the purposes for which we obtained it, in accordance with the provisions of this Privacy Policy or (ii) we have another lawful basis for retaining that data beyond the period for which it is necessary to serve the original purpose for collecting the data. To the extent that you have stored, submitted, transmitted, disclosed, or shared Personally Identifiable Information to or with us, unless otherwise restricted by applicable law, PostOddz will take reasonable steps to dispose of or arrange for the disposable of your Personally Identifiable Information within its custody or control by shredding, erasing, or otherwise modifying your Personally Identifiable Information to make it unreadable or undecipherable by any means if: (i) PostOddz ceases operations or (ii) you delete the App, and provide written notice to 9611 Lincoln Boulevard, Carmel, IN 46280.

\ni. We encourage you to review our Privacy Policy not just the first time you visit the App but periodically afterwards since we may modify our Privacy Policy from time to time. The date of the last update of the Privacy Policy will always be posted below. This Privacy Policy was Last Revised on September 8, 2021. If we make any substantive changes to our Privacy Policy in the future with regard to how we use your Personally Identifiable Information, we will incorporate those changes here. If we make material changes to how we treat our users' Personally Identifiable Information, we will notify you by email to the email address specified in your PostOddz Account. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our App and this Privacy Policy to check for any changes. By providing us with your email address, you consent to us sending you notice via email of our Privacy Policy changes. Your continued use of the App after the changes are posted or after we notify you via email constitutes your agreement to the changes, both with regard to information we have previously collected from you and with regard to information we collect from you in the future. If you do not agree to the changes, please discontinue use of the App. Lastly, if PostOddz is sold or merged with another company, your Personally Identifiable Information will be included as part of the sale, but unless you’re notified that the Privacy Policy is changed, your Personally Identifiable Information will be maintained in the same manner as described in the Privacy Policy.

\n \n5. Not Intended for Use By Individuals Under 18 Years of Age
\nOur App is not intended for anyone under eighteen (18) years of age. We do not knowingly collect personal information from anyone under 18. If you are under 18, do not: (i) use or provide any information on the App or, on or through any of the features available on the App or (ii) provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you seek to or may use. If we learn we have collected or received personal information from an individual under 18, we will delete that information. If you believe we might have any information from or about an individual under 18, please contact us via email @ info@postoddz.app so that we can have this information removed and/or deleted. By using this App, you represent that you are at least eighteen (18) years of age.
\n\n6. Security
\nTo prevent unauthorized access, maintain data accuracy, and ensure the correct use of Personally Identifiable Information, we have put in place reasonable physical, electronic, and managerial procedures to safeguard and secure the Personally Identifiable Information we collect online, and we make good faith efforts to store your Personally Identifiable Information in a secure operating environment. You must also seek to protect against unauthorized access to any information that you use in connection with the App, and you should remember to close App if you have decided to step away from your mobile device. In the event that we determine that there has been a security breach resulting in the unauthorized disclosure of Personally Identifiable Information to a third party, we will notify individuals whose Personally Identifiable Information has been so disclosed as required by law. Unfortunately, no data transmission over the internet or through mobile platforms can be guaranteed to be absolutely secure. As a result, while we strive to protect your Personally Identifiable Information, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk.
\n\n7. Links and 3rd Parties
\nThe App includes links to other third-party websites, which are not operated by PostOddz, that we think may be of interest to you, including, but not limited to links to PostOddz’s accounts on various social media websites. These third-party websites have separate data collection and privacy practices independent from ours, and PostOddz is not responsible for the policies or activities of such other websites. We encourage our users to be aware when they leave our App and to read the privacy statements of any other site that collects personally identifiable information. Please contact such third parties directly if you have questions about their privacy policies.
\nIf you voluntarily disclose information in an e-mail or other communication with third parties found on the App or in other materials, that information, along with any other information disclosed in your communication, can be collected and correlated and used by such third parties and may result in you receiving unsolicited messages from other persons. Such collection, correlation, use and messages are beyond our control.
\nWe do not warrant specific third parties or their goods or services, regardless of whether such third parties offer goods or services on the App from time to time. Any relationship between you and such third parties will be governed exclusively by the terms offered by the third party and agreed to by you. If you provide these third parties with any Personal Information or other information, their use of such information will be subject to their privacy policies, if any, and will not be governed by this Privacy Policy. In addition, if you accept third-party goods or services advertised on the App, a third party may be able to determine that you have a relationship with us (e.g., if the offer is made only through the App).
\n\n8. State Specific Laws
\nCalifornia Residents:
\nCalifornia Civil Code Section §1798.83 permits users of our App that are California residents to request, once per year, that we disclose the identity of any third parties with whom we have shared personal information for the third parties’ direct marketing purposes within the previous calendar year, along with the type of personal information disclosed. To make such a request, please send an email to info@postoddz.app.
\nIf would like to exercise any of these rights, please contact us via email @ info@postoddz.app. You will be required to verify your identify before we fulfill your request. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf. You will still need to verify your identity directly with us.
\nCalifornia residents may opt out of the “sale” of their personal information. Sale is broadly defined such that it may include allowing third parties to collect or receive certain information, such as cookies, IP address, and/or browsing behavior, to deliver targeted advertising on the Services or other services. Advertising, including targeted advertising, enables us to provide you certain content for free and allows us to provide you offers relevant to you.
\nIf you would like to opt out of PostOddz’s use of your information for such purposes that are considered a “sale” under California law, you may do so by submitting a sale opt-out request by emailing us at info@postoddz.app. Please note that we do not knowingly sell the personal information of minors under eighteen (18) years of age without legally-required affirmative authorization.
\nNevada Residents:
\nUnder Nevada law, certain Nevada consumers may opt out of the sale of “personally identifiable information” for monetary consideration (as such terms are defined under Nevada law) to a person for that person to license or sell such information to additional persons. We do not engage in such activity; however, if you are a Nevada resident and you have purchased services from us, you may submit a request to opt out of any potential future sales under Nevada law by submitting a sale opt-out request by emailing us at info@postoddz.app. Once verified, we will maintain your request in the event our practices change.
\n9. Opting Out
\nDeleting Your Account and Data: PostOddz allows you to deactivate your account and any data associated with it for any reason at any time. In order to completely delete your account and all of the data associated with it, email us at info@postoddz.app. We will respond with a confirmation within 30 days.
\nCommunication Settings: You have the right to opt out of receiving promotional materials or other forms of contact which may include email or directly in the app. If you wish to opt out of receiving these materials, you can do so directly by following the unsubscribe prompts in the materials. This option does not apply to communications primarily for the purpose of administering orders, contracts, support, product safety warnings, software updates, or other administrative and transactional notices.
\nOption to Opt Out Of Sharing: You have the option to opt out of having your information shared with third parties such as our partners. If you wish to opt out of having your personal information shared, email us at info@postoddz.app in order to let us know. We will respond with a confirmation within 30 days.
